02. What we use and why
We use your contact, billing and order details to handle enquiries, take payment, deliver your game and provide support. We use the photos, names, relationships, memories and dedication you supply to create the agreed experience. Necessary customer information is processed to take requested steps before a contract or perform it.
We keep required business records to meet legal obligations. Security and handling disputes are based on our legitimate interests, balanced against the rights of the people concerned. Optional analytics uses consent. Public use of a story or photographs is agreed separately.
A First 100 submission includes your name, email, memory and our correspondence. A private copy is stored in WordPress and sent to our inbox so we can consider and discuss it with you. Buying a game or submitting a story does not subscribe you to a newsletter.
03. People in your story
Share only material you are entitled to use. Involve the people shown and the appropriate parent or guardian for children. Please give them this notice. If someone has supplied information about you, contact us to ask about it or request its removal.
Do not send identity documents, payment-card images, medical records or unnecessary sensitive details. If sensitive information is essential to a story, contact us before sending it so we can establish an appropriate approach and legal basis.
04. Private by default
Your online game is protected by a password supplied with its link. Keep your brief link, game link, password and downloaded package private, sharing them only with people you choose. Someone you give access to can still copy or forward the material.
Your order is not automatically added to our catalogue, social media or The First 100. Publication requires a separate agreement about the material and where it may appear.
05. Providers helping us
We share information only as needed to provide the service, administer the business or comply with law:
- Hosting and email: Spaceship hosts the website; Spacemail handles correspondence and attachments.
- Payments: Stripe handles card payments under its privacy policy. We receive payment status and order information, not your full card security details.
- Visual production: specialist external services for digital photo editing and visual asset creation receive selected photographs and relevant story details. We disable optional use of submitted content to improve their models. This does not prevent storage needed to operate and secure those services or comply with law.
- Measurement: Google Analytics measures website use with consent, as described in our Cookie Policy.
Some providers process information internationally, including in the United States. Contact us for details of the providers handling your material and their processing arrangements.
06. How long we keep it
- Original photos and unused production material: up to 90 days after final delivery, including an included revision if requested. Without a revision, the period starts at initial delivery. We then delete working copies under our control and request deletion of corresponding production-service copies.
- Finished game and dedication: kept for the agreed 12 months of online access, or an agreed extension. We notify you 30 days before online access ends. Images incorporated into the game remain part of it; deleting originals does not remove them. You retain the downloadable package supplied at delivery.
- Unselected First 100 submissions: deleted 12 months after submission unless we agree to continue with the author.
- Other enquiries: kept while handling the enquiry and for up to 12 months after the last substantive contact, unless needed for an order or a specific claim.
- Order and business records: kept for applicable tax and recordkeeping periods and, where needed, until a specific claim and its applicable limitation period are resolved. We retain only what that purpose requires.
Our deletion process includes relevant source-photo attachments and production conversations under our control. Production providers may need up to a further 30 days to complete deletion, with limited security or legal exceptions. Backup and security records can follow separate retention cycles. We can explain the applicable retention for information about you on request.
07. Your rights
Depending on the circumstances, you can request access, correction, deletion, restriction or a portable copy of your information. You can object to processing based on legitimate interests. You can withdraw consent without affecting earlier lawful processing.
Email info@memoduck.com. We may need proportionate information to verify your request. We normally respond within one month and explain any permitted extension within that time.
You can complain to the Czech Office for Personal Data Protection or the competent authority where you live, work or believe an infringement occurred. We update this notice when our practices change and provide additional notice where required.
