01. Who you are buying from
Memoduck is operated by Jakub Šlechta, a Czech sole trader, IČO 06102255, Starodvorská 9/3, Praha 6–Lysolaje, 165 00, Czech Republic. Contact: info@memoduck.com. The seller is not registered as a Czech VAT payer.
These terms apply to Memoduck Bespoke orders. Orders must be placed by an adult able to enter into the agreement.
02. What is included
Memoduck Bespoke — US$299: one real memory made into a custom game, with 5–7 scenes, characters based on your photographs, custom settings, dialogue and interactions.
Your gift includes a title and personal dedication, a password-protected playable link, 12 months of online access, a downloadable game package supplied at delivery, and one round of minor revisions.
3 bespoke story slots available each week. Each game is created individually. Your production slot is confirmed after we receive your complete materials and agree the story; payment alone does not reserve a production date.
03. Ordering and payment
Pay through checkout, then send your photographs and story through your personal brief link. Checkout shows the total payable in US dollars before you commit to payment. Your bank may charge for currency conversion.
Your order is accepted when we send its acceptance confirmation after successful payment. An automated payment receipt alone is not a separate acceptance unless it expressly confirms acceptance of your order. We send the terms applying to your order with the confirmation so you can keep a copy.
If a confirmation or brief link is missing, contact us with your order number. Never email card details.
04. Your story and delivery
Delivery takes 5–7 business days after we receive all necessary materials and agree the story, or from a later production start date agreed with you. Business days are Monday to Friday, excluding Czech public holidays. An applicable withdrawal waiting period also applies unless you expressly request earlier performance as explained in Delivery & Refunds.
We confirm the story and production date with you before starting. If we cannot deliver as agreed, we will contact you; your rights concerning late or failed delivery remain unchanged.
If your materials are still incomplete 60 days after purchase, we will cancel the order and refund the full payment after sending you a reminder and giving you a reasonable opportunity to respond. This does not apply if we have agreed a later date with you.
05. Revisions and playing
Request your included round of minor revisions within 14 days of initial delivery. It covers wording, names and small details within the agreed story. A different story or extra scenes require a separate agreement and price. Fixing a defect does not use up this revision round.
The online game needs an internet connection and a compatible web browser. Game progress and preferences may be stored in your browser; clearing site data can reset them. We confirm any essential device requirements with you before accepting an order. The download comes with instructions for running your copy; it is a playable package, not a mobile app installation.
06. Your materials and use of the game
You keep the rights you hold in your photographs and text. You allow us and the providers helping us to use and adapt them as needed to create, deliver and support your game. Send only material you are entitled to share and obtain the necessary permission for people depicted, especially children.
You and your gift recipient receive a non-exclusive licence to play the delivered game for personal, non-commercial use and privately share it with family and friends. Resale and other commercial use require a separate agreement. Memoduck tools, reusable code and assets remain with their respective rights holders; delivery of a playable package does not transfer their ownership.
07. Privacy and online access
Your game is private by default and its online access is protected by a password supplied with the link. Share both only with people you choose. Recipients can still copy or forward material they can access. Public use in our catalogue, portfolio or advertising requires a separate agreement; it is never a condition of purchase. See our Privacy Policy.
Online access lasts 12 months from initial delivery. We email a reminder 30 days before it ends. Unless we agree an extension, the online link stops working at the end of that period. There is no automatic renewal or charge. You keep your downloaded package; we do not promise permanent compatibility with future devices or software, without limiting mandatory rights to remedies or updates.
08. Cancellation and complaints
A personalised game does not automatically remove your consumer rights. Our Delivery & Refunds page explains withdrawal, refunds, defects and how to contact us. Those rules form part of these terms. Your statutory rights are not limited by the included revision round or the hosting period.
09. The First 100
The First 100 is a separate, free invitation to submit a memory for possible inclusion in our wider collection. It does not buy Bespoke, guarantee selection or permit publication. Future crowdfunding and creator tools are separate from the individual game you order today.
10. Resolving a problem
Contact info@memoduck.com first so we can try to resolve the issue. Unresolved consumer disputes can be referred to the Czech Trade Inspection Authority’s alternative dispute resolution service.
Czech law applies, without taking away mandatory consumer protections or remedies applicable in your country of habitual residence. Changes to this page do not automatically change an existing order. No term excludes rights or liability that cannot legally be excluded.
